الملخص العربى : يمر المدين المتعثر بالعديد من الصعوبات الاقتصادية التي تحول بينه وبين الوفاء ببعض ديونه ،کما تحول بينه وبين تحقيق أهدافه وغايته  الاقتصادية التي يعمل لأجلها ، فيصبح في حالة تعثر اقتصادي يوجب تدخلا قضائيا للنظر في أمره ،ولما کان ترک المتعثر دون تدخل قد يلحق به ضررا بالغا بالاقتصاد القومي ،فضلا عن أضراره المجتمعة ،نظرا للبطالة التي قد تنجم عن تسريح العاملين في الشرکة المتعثرة وإدراج أموال المساهمين فيها. ولذلک تناولنا موضوع إعادة هيکلة المدين المتعثر من خلال خطة بحث تتضمن مبحثين :- المبحث الأول بعنوان الشروط الشکلية لإعادة هيکلة المدين المتعثر وتناولناه من خلال مطلبين :- المطلب الأول بعنوان :- تقديم طلب مکتوب إلي المحکمة بإعادة الهيکلة ، ومطلب ثان بعنوان :- صدور حکم من قاضي الإفلاس بالموافقة علي الطلب . المبحث الثاني :- الشروط الموضوعية لإعادة هيکلة المدين المتعثر وتم تقسيمه إلي مطلبين :- المطلب الأول بعنوان :- شروط توافر الصفة التجارية ، ومطلب ثاني تناولنا من خلاله شروط التوقف عن الدفع .وفي النهاية خاتمة تتضمن ـهم النتائج والتوصيات التي توصلنا إليه من خلال البحث الملخص الانجليزى : In order for economic tourism to achive the expecation that it will becomeeconomic for you In order to become economic for you , you must enter into his matter willngly ، in addition as well ' as well as the combined damages due ti the unemployment that results from the dismissal of workers in the troubled company and the inclusion of the money in it . the troubled debtir goes through many economic difficulties that preventhim from fulfilling some of his debts ,and it also prevents him fir achieving his goals and the economic gial for which he is working ، so he becomes in a state of economic failure that necessitates ajudicial intervention to look intohis mattar and since leaving the defaulted person without intervenation may causehim serious harm the national economy  as well as its combined harm in view of the unemployment that may result from  layoffs in the troubled company and the inclusion of shareholders money in it
