يعد هذا الموضوع من الموضوعات الهامة في مجال القانون الجنائي والفقه الإسلامي، وتزداد أهميته لأنه يتعلق بحماية جسم الإنسان وعدم الاعتداء عليه بأي نوع من أنواع الاعتداء من قبل ولادته وحتى بعد مماته، وتقنين التطور الطبي في التعامل معه، لأن الإنسان بنيان الله فلا يجوز الاعتداء عليه، والموضوع محل الدراسة وثيق الصلة بالقرآن الكريم والسنة النبوية في الاعتماد عليهما في جمع الأدلة لأنهما مصدرين أساسيين من مصادر التشريع الإسلامي. ولذا سوف نقسم الدراسة في هذا البحث إلى مبحثين: المبحث الأول: مفهوم الحماية الجنائية لجثة الإنسان. المبحث الثاني: تعريف الموت وتحديد لحظة حدوثه وترجيح ما يستحق الترجيح. ثم زيلت البحث بخاتمة اشتملت على النتائج وقائمة المصادر والمراجع. The topic is one of the most important topics of criminal investigation and islamic jurisprudence. Its importance because it's related to the protection of human body and the non-aggression of any kind from before birth to death. And the legalization of medical development in dealing with it, because only the human being is the structure of God, it isn't permissible to attach him. The subject under study is closely related to the Qur'an and the Sunnah of the prophet in reliance on them in gathering evidence because they are two basic sources of Islamic Legislation. So the study in this research was divided into two sections : The First Section « Topic » : The conceopt of criminal protection for the human body. The Second Section « Topic» : Defining death, determining the moment of its occurrence and weghing what deserves weighting. Then, the research concluded with a conclusion that included the results.
