يدور هذا البحث الأطروحة حول أعمال الضبطية المنشئة للمسئولية المدنية، فقد حظي عمل مأمور الضبط القضائي الشرطي في الآونة الأخير باهتمام بالغ مرجعة تطور الجريمة وأنماطها وصورها من ناحية، والتقدم العلمي بآلياته وأدواته التي يتطلبها حفظ الأمن من جهة، وما قد ينجم عن ذلک من انتهاک أو مساس بحقوق الأفراد وحرياتهم من جهة أخرى، ولا يغيب عن فطن أن مأمور الضبط القضائي موظف عام تتم مساءلته عن خطأه المهني علي ضوء أحکام المسئولية المدنية؛ حيث يسأل مدنياً عن الضرر الناجم عن خطئه الثابت أو المفترض، والأمر علي هذا النحو يثير مسئولية الدولة عن تعويض الأضرار الناشئة عن عمل مأمور الضبط القضائي الشرطي کمتبوع عن أعمال تابعة أو عن الخلل في أداء العمل، وذلک ما درج الفقه علي تسميته بالخطأ المرفقي أو استناداً لتحمل التبعة. Abstract This thesis research revolves around the police work establishing civil responsibility. The work of the police judicial control officer has recently received great attention, referring to the development of crime, its patterns and forms on the one hand, and scientific progress with its mechanisms and tools required for maintaining security on the one hand, and the resulting violation or Infringement of the rights and freedoms of individuals on the other hand. It should not be forgotten that the judicial police officer is a public servant who is held accountable for his professional error in the light of the provisions of civil liability; Where he is civilly responsible for the damage resulting from his fixed or presumed mistake, and the matter in this way raises the responsibility of the state to compensate for the damages arising from the work of the police judicial control officer as a follower of subordinate actions or from defects in the performance of the work, and this is what jurisprudence has traditionally called an attachment error or based on to bear the liability.
