من الثوابت القانونية والعملية أنه لا يجوز لأحد الاعتذار بالجهل بأحکام القانون الجنائي حتى لا يفلت المجرمون من العقاب بادعاء عدم العلم، ولهذا کان العلم بأحکام القانون الجنائي مفترض من واقع نشر القانون في الجريدة الرسمية، وذلک بخلاف الجهل بالواقع إذ من شأنه تخلف رکن العلم اللازم لقيام الجريمة. وفى الحقيقة نظراً لصرامة هذه القاعدة عمد القضاء إلى التخفيف من حدتها، فأجاز الاعتذار بالجهل متى انصب على قاعدة قانونية غير جنائية تدخل عنصرا في الجريمة، معتبرا ذلک جهلا مختلطا ما بين الواقع والقانون، يعد برمته جهلا بالواقع ينفي القصد الجنائي متى أثبت المتهم أنه تقصى وتحرى أو لم يکن في مقدوره العلم ولقد أيد الفقه القضاء في ذلک نظرا لسلامة أساسه.    Abstract It is a legal and practical principle that no one may apologize for ignorance of the provisions of the Criminal Code so that criminals do not go unpunished by claiming that they do not know, and therefore knowledge of the provisions of the Criminal Code was assumed by the fact that the law was published in the Official Gazette, other than ignorance of the reality, as it would leave behind the flag of the crime. In fact, given the rigour of this rule, the judiciary has reduced its severity, authorizing an apology with ignorance when it is based on a non-criminal legal basis that is an element of the crime, considering it a mixed ignorance between reality and the law, which is entirely ignorant of reality that denies criminal intent when the accused proves that he investigated and investigated or could not know, and the jurisprudence supported the judiciary in this regard to the integrity of its basis.
