تهدف هذه الدراسة لعرض النظام القانوني للغرامة التهديدية في القانون المدني الليبي والتشريعات المقارنة، وذلک من خلال تحديد المفهوم والطبيعة القانونية وشروط تطبيقها والآثار التي تترتب عليها، وقد تبين أن هناک العديد من نقاط الاختلاف بين موقف التشريع الليبي وبعض التشريعات عند تنظيمها لهذه الوسيلة. وقد خلصت الدراسة لبعض النتائج والتوصيات التي نأمل أن تنال اهتمام المشرع الليبي.  The study aims to introduce the legal regime of the threatening fine in libya civil law and comparative legislation by defining its concept, legal nature, conditions of application and effects, and it has been found that there are many points of disagreement between the position of libya legislation and some legislation regarding its regulation of this method.The study has drawn some conclusions and recommendations that we hope will be of interest to the legislature.
