مما لاشک فيه أن أهم القواعد القانونية والمکونة لأى مجتمع متحضر هى الدوافع الأخلاقية التى تجعل من قواعد الأخلاق رکيزة أساسية في بناء المجتمعات، وأن العلم قد أظهر أن نوعية الشخصية ترتبط بتکوينها الجسدي، ويعد الذکاء، والقدرات الخاصة، واکتساب المعلومات من البيئة الاجتماعية التي يعيش فيها من أهم الآثار الفکرية التي تفسر سلوک الإنسان، ويعد الغشاش أخطر أنواع التصنيف الإجرامي ؛ لأن الغشاش في عرف القانون مجرم، وفى عرف علوم النفس البشرية مريض نفسى، ولأن ازدواجية السلوک الشخصي للفرد داخل المجتمع هي تقوده إلى وقوع الجريمة، فکان لابد من إيجاد الحلول، وکيفية توجيه الدافع الأخلاقي لمنع ارتکاب الجريمة.
فالغش يفسد کل أمر، وهو مبدأ عام مستمد من القواعد والقيم الأخلاقية والاعتبارات الاجتماعية ومبدأ حسن النية، مما يوجب يقظة المجتمع لردع هذه الجريمة حرصا علي سلامة الأفراد والجماعات، فإن التأثير الوراثي هو الأصل في الإنسان، وهو الذى يوجد في کينونته ويستمده من خلال الوسط الذى يختاره عند بلوغه سنا معينة، فإن تسجيل العلامة التجارية کأهم التطبيقات القضائية هو مناط الحماية التى أسبغها القانون رقم 57 لسنة 1939 على ملکيتها الأدبية بتأثيم تقليدها أو استعمالها من غير مالکها الأصلي، فتجب حماية الملکية الفکرية، وأن تأمر المحکمة بمصادرة الآلات والأدوات التى تستخدم فى تزوير العلامات وتقليدها.

Fraud corrupts every matter, and it is a general principle derived from the rules, moral values, social considerations, and the principle of good faith. Society must be vigilant to deter this crime for the safety of individuals and groups.
