Abstract

Guarantees of the fair trial for the accused in Romanian law and Islamic Shari'a Islamic Shari'a, international charters and contemporary criminal procedure laws in different countries approved the necessity that the accused should enjoy many guarantees during his trial with the aim of achieving justice. If criminal justice harms the perpetrators of a crime without punishment, it will also do more harm if an innocent person is convicted or his rights are violated during his trial, which is considered an apparent injustice. In view of the situation in Romanian law, which is rightly an important source of many laws of Arab States, we will note that the status of the accused has varied from time to time, depending on the circumstances of the political, social and religious society, unlike that of Islamic law. I will therefore clarify these guarantees for the accused in Romanian law and Islamic Shari'a, which are important in scientific and practical terms, divided by research into an introduction, an introductory demand, and two parts.
