فهذا تحقيق لمخطوط بعنوان: "القواعد المحررة في ميراث الرجل والمرأة" للشيخ أحمد الخليلي الشامي، وقد اختصر المصنِّف مسائل الفرائض بأسلوب فقهي ميسر، فتوجهت الرغبة لتحقيقه؛ إسهامًا في خدمة التراث الفقهي عمومًا، وإبرازًا لهذه المخطوطة القيِّمة على وجه الخصوص، ولم يتبين لي - بعد البحث والتقصِّي - أنَّه سبق تحقيقه، وقد جاء البحث في مقدِّمة، وقسمين، وخاتمة، وفهرسين، فالقسم الأول: في التعريف بالمصنِّف ورسالته، والقسم الثاني: في النص المحقق، واعتمدت على النسخة الوحيدة التي وقفت عليها، وهي نسخة مکتبة مخطوطات المسجد النبوي، وقد تبيَّن لي صحة نسبة المخطوط إلى مصنِّفه، وتبيَّن أن المصنِّف ذکر غالب أبواب الفرائض، بصورة موجزة جدًا، فذکر الوارثين من الرجال والنساء، وأصحاب الفروض، وما يستحقه کل صاحب فرض، ومتى يحجب، وذکر قواعد في أصول المسائل، وعددًا من المسائل الفرضية لأصحاب الفروض، والعصبة، ومسائل في تأصيل المسائل، وتصحيحها، وعولها، وذکر باب الحمل، وباب المفقود، وباب الخنثى، واكتفى في بقية الأبواب بالجانب التطبيقي، وذلك بإيراد المسائل دون بيان أحكامها نظريًّا. This research is a verification of the manuscript entitled: “The Rules Established for the Inheritance of Men and Women" by Sheikh Ahmed Al-Khalili Al-Shami, who summed up the inheritance obligations in an easy jurisprudential style. This study contributes to the jurisprudential heritage in general, and highlights this valuable manuscript in particular, which apparently has not been edited before. The research paper consists of an introduction, two sections, a conclusion, and two indexes. The first section introduces the author and his message, and the second deals with the verified text of the manuscript. I relied on the only copy that I found, which is the copy at the Library of the Prophet's Mosque. It's been proved that the manuscript was written by Al-Khalili, who briefly mentioned most of the related obligations. He mentioned the male and female heirs, those entitled to inheritance shares, what each of them is entitled to, and when it is withheld. He mentioned rules related to fundamental issues, and a number of hypothetical issues for those entitled to inheritance shares, the father's relatives, and issues to be judged and corrected in light of Sharia. He mentioned issues related to pregnancy, the missing, and the hermaphrodite, each in a separate section. As for the rest of the issues, he focused on the practical aspect, by mentioning the rulings without explaining their theoretical background.
