يتناول هذا البحث بيان الأثر الفقهي للقواعد الفقهية الكلية المتعلقة بالتلوث البيئي وهي التغيرات غير المرغوبة التي تحصل في محيطنا، أهمها التي تنتج من نشاطات الإنسان، ومن خلال التأثيرات المباشرة وغير المباشرة في تغير شكل الطاقة ومستويات الإشعاع، والبيئة الكيمائية والطبيعية للكائن الحي، وهذه التغيرات سوف تؤثر بصورة مباشرة في الإنسان أو من خلال ما يحيط به فيما يحتاجه من ماء وزرع وغيرها من الموارد الطبيعة، ولحماية هذه البيئة يأتي دور القواعد الفقهية الكلية التي تكفل للإنسان ممارسة حياته دون أن تمتد يده إلى البيئة بالفساد، وعلى سبيل المثال القاعدة الفقهية الكلية الكبرى "لا ضرر ولا ضرار" وغيرها من القواعد الفقهية، والتطبيقات المعاصرة لها، ومن نتائج البحث: أن القواعد الفقهية الكلية تتجه إلى البيئة اتجاهين اثنين: الأول: الحفاظ عليها، وعدم إفسادها وتخريبهًا، والثاني: تعمير الأرض، والعمل على تجديدها، ورعايتها بتنميتها، ومن الأثر الفقهي لقاعدة "الأمور بمقاصدها" فالنية يمكن أن تحول العادات في إصلاح البيئة وعمارتها وحمايتها من التلوث إلى عبادات.
This research deals with the jurisprudential impact of the universal jurisprudence rules related to environmental pollution, which consists in the undesirable changes resulting from human activities and occurring in our surroundings, due to direct or indirect effects of changing the form of energy and radiation levels and the chemical and natural environments of the living organism. These changes will directly affect the human being or indirectly by affecting his surroundings such as water, crops and other natural resources. The universal jurisprudence rules play an important role in allowing man to practice his life without harming the environment. One of these great general jurisprudential rules is “neither harm nor be harmed." The results of the research show that the universal jurisprudential rules deal with the environment in two directions: the first is to preserve it, and not damage or destroy it. The second is to reconstruct the land, work on its renewal, and take care of it by developing it. The effect of the jurisprudential rule which states that “matters are judges by their intentions" is that intention can transform such habits as repairing the environment, building it and protecting it from pollution from normal acts into acts of worship.
