من أعظم المقاصد الشرعية إقامة العدل ودفع الظلم والفصل في الخصومات والمنازعات ، ويُعد التحکيم في المجالس العرفية من أقدم الوسائل للفصل في المنازعات ، وعندما جاء الإسلام أثبت مشروعيته وهذبه بضوابط وشروط حتى برزت مبادؤه وأحکامه وحقق غايته ، فإذا اتفق الخصوم على التحکيم وارتضيًا محکمًا فحکم بما شرع الله فعليهما تنفيذ حکمه ، ويظهر عدل الشريعة وحفظها للحقوق في قواعد الضمان دفعًا للضرر ، وقد يترتب على حکم المحکم عوضًا ماليًا مقابل ضرر استوجب الضمان فأخذ العوض ليس حرامًا ولا مکروهًا فقد شرعت الحدود والتعزيرات في الشريعة الإسلامية زواجر وعقوبات رادعة .
One of the greatest legitimate purposes is to establish justice, fight injustice and settle disputes and quarrelling. Arbitration in customary councils is one of the oldest means for settling disputes. When Islam came, Islam proved customary council's legitimacy and controlled it with regulations and conditions until its principles and provisions emerged and achieved its goal. If two quarrels agreed upon arbitration and they both were satisfied with a judge and that judge made a judgement according to Allah's Islamic jurisprudence , then they both have to implement his judgment, and the justice of Shariaa and its preservation of rights are shown in the rules of guarantee in order to ward off harm, and the arbitrator's judgment may result in a financial compensation in exchange for damage that necessitates the guarantee, so taking the compensation is neither forbidden nor disliked, for the limitations and punitive measures have been legislated in Islamic Shariaa as deterrent punishments.
