تتضمن هذه الدراسة بحث مسألة دقيقة من مسائل الشيکات التي يجدر إلقاء الضوء عليها ودراستها وفق ما جاء في نظام الأوراق التجارية السعودي، وتکمن أهميتها في عدم تطرق المنظم السعودي لها منعاً أو إباحة، رغم إضفائه الکثير من تفاصيل الأحکام على الشيکات، وقد جرى إيضاح هذه المسألة بتعريفها، وبيان أهم شروطها، وتحرير محل النزاع فيها، وإيراد موقف بعض التشريعات حيالها، ومقارنة ذلک بالواقع العملي السعودي، ومن ثم بيان آثار الامتناع عن الوفاء بها في نظام الأوراق التجارية والأنظمة الأخرى ذات العلاقة کنظام التنفيذ ولائحته التنفيذية، سواء کان هذا الامتناع عن الوفاء في مواجهة الحامل المستفيد من الشيک، أو في مواجهة القضاء، مع إيضاح العقوبات القانونية المقررة بحق الممتنع عن الوفاء في کلتا الحالتين، وقد تم اختتام البحث بجملة من النتائج والتوصيات التي نرجو أن تکون نافعة ومحققة لروح النظام ومقاصده.   Abstract Non-Bank models Issued Checks
and the Effects of its non-constancy in Saudi Law Originality Study This study includes a research of one accurate case of checks' cases which should be highlighted and to be studied according to the Saudi Commercial Documents law includes, its importance is that the Saudi legislator must not rejects or permits it, in spite of he adds a lot of judgments' details on checks, and this case has been cleared and defined, mentioning its most important conditions, submitting the conflict I, telling some of legislations' attitudes about it, and comparing that with the Saudi practical reality, then showing the effects of non-constancy of it in the Commercial documents and the other laws as Implementation Regulations and Regulations, whether this is against the recipient who has the check or against the judiciary, all the Legal sanctions must be cleared in both cases. This research was concluded of set of results and recommendations which we hope to be useful and reaching the law's spirit and its purposes.
