Counter- Tendencies within the Islamic Legislation in between the Needs of the Sharia and selected Articles quoted from the amended Jordanian Law of Islamic Procdures No. 31  By: Osama Radwan Mohammed Al-Jawarneh Department of Jurisprudence and its Fundamentals Irbid University College Al- Balqa Applied University Hashemite Kingdom of Jordan Abstract   This research sheds light on a legal and legitimate issue; achieving moderation on both ways (balance and averageness) with reference to the provisions of the Islamic Sharia and some selected articles quoted the amended Jordanian law of Islamic procedures No. 31 of 2016 by employing and empowering the role of counter- tendencies as a rule leading to giving up obstinacy following the inductive and deductive approaches. This research is a keen attempt of the researcher to connect his study to relevant jurisprudential rules، demonstrating the relationship in between the objectives of the responsible and those of the Islamic legislation. In addition، the research highlights the reconciliation between the concept of moderation in the Islamic jurisprudence and the existence of some legislations that seemingly look incompatible with this concept. Hence، this research discusses the utilitarian view of the serious ends of obstinacy and their effects on both the individual and society. Accordingly، the researcher has considered conducting this study in reality through employing and relating it to applied articles utilized in the Islamic courts throughout the new amended Jordanian law of Islamic procedures of 2016 hoping to introduce a complete image and a clear vision around this topic.
