ملخص البحث    إن مراعاة المآلات تجسد معنى صلاحية الشريعة الإسلامية لکل زمان ومکان؛ وذلک لمرونتها وواقعيتها وقوة استيعابها. وقد تنوعت الأدلة الدالة على مراعاة المآلات من القرآن والسنة، وآثار الصحابة وقد تضافرت بمجموعها في الدلالة على قطعية مراعاة المآلات وإذا اعتبرها الشارع فيجب على المجتهد اعتبارها.کما إن مبدأ مراعاة المآلات من أهم القواعد التي يتأسس عليها علم مقاصد الشريعة، وذلک لما يمتاز به من الموازنة بين المصالح والمفاسد. وقد تبين من البحث إن الشريعة الإسلامية لا تقتصر في مراعاة المآلات على ما هو متحقق وواقع بالفعل بل يمتد نظرها إلى ما يتوقع حصوله في المآل. ومن أهم التوصيات تخصيص مراعاة المآلات بالدراسة في الندوات والملتقيات، وإظهار أثرها في فقه الواقع وفقه الدعوة، وإعادة دراسة منهج القرآن والسنة النبوية في تعليل الأحکام بالمآلات، وهل الأحکام المعللة بمآلاتها صالحة للقياس علها إذا اتحدت أو تشابهت المآلات في کل من الأصل المقرر في النص الشرعي والمسألة المستجدة.   هذا، وآخر دعوانا: أن الحمد لله رب العالمين                                                     
  Considering Consequences in Islamic Legislation By: Iqbal Fadhil Mohammed Al-Mesri A PhD. candidate Department of Islamic Sharea Faculty of Dar Al-Uloom Cairo University   Abstract Considering consequences embodies the meaning of having an Islamic Sharea valid for all time and place because it is realistic, flexible and all-inclusive. Clues on considering consequences are variously found in the Holy Qur'an, Sunnah and traces of Prophet Muhammad's companions. Collectively, those clues give clear-cut evidence on considering consequences by the All-wise legislator and therefore, any hard worker has to follow those traces. The principle of considering consequences is one of the most important bases upon which the science of objectives of Sharea relies on because of the advantage of creating a balance in between the merits and demerits. Throughout the research, it has been proved that the Islamic Sharea does not only consider the consequences of what is realistic or actual, but it also foreshadows future consequences. Finally, the research has recommended focusing more light on studying consideration of consequences though forums and symposia to expose their influence upon jurisprudence of reality and Islamic call to Allah. The research has also recommended restudying the approach of the Holy Qur'an and the prophetic traditions in order to give reasons for provisions by considering consequences and tell if those provisions could be borrowed when we have similar consequences in terms of the genuine legal text and the up-to-date issue.
