ملخص البحث:
تعتبر الأسرة الرکيزة الأساسية لبناء المجتمع، وقد اعتنى بها الشارع ببسط أحکامها من خلال قوله تعالى: (وَعَاشِرُوهُنَّ بِالْمَعْرُوفِ).
والزواج في الإسلام ليس مسألة فردية فقط، بل له بعد اجتماعي وإنساني، ومن ثم فالدولة الإسلامية مطالبة بالاعتناء التام والتحصين المحکم لحماية الأسرة من التفکک والفرقة، وذلک عن طريق التثقيف الشرعي والتربوي والنفسي قبل الزواج. وأيضاً توجيه الإعلام لبناء ثقافة توعوية أسرية.
الزواج مبني على الرضا والقبول، وهي صيغة العقد التي تستلزم وجود العاقدين، والمعقود عليه.
وهناک شروط لابد من وجودها، بحيث إذا فقدت کلها أو بعضها، لا يکون للعقد وجود شرعي، وهي شروط الانعقاد، لأنها متعلقة بالصيغة. ثم بعد ذلک تأتي شروط الصحة التي إذا تحققت کان العقد صالحاً لترتب آثاره الشرعية عليه، وإذا تخلفت کان العقد فاسداً.ثم تأتي بعد ذلک شروط النفاذ وهذه إذا تحققت ترتب عليها آثار العقد بالفعل، ثم تأتي أخيرا شروط اللزوم، ومعنى اللزوم: ألا يکون لأحد الزوجين أو غيرهما حق فسخ العقد.

Abstract:
The family is the basic foundation for building society, and the street took care of it by extending its provisions through the Almighty's saying: (And live with them with kindness).
Marriage in Islam is not only an individual issue, but has a social and human dimension, and therefore the Islamic state is required to take full care and tight fortification to protect the family from disintegration and division, through legal, educational and psychological education before marriage. And also directing the media to build a family awareness culture.
Marriage is based on consent and acceptance, which is the form of the contract that requires the presence of the contractors, and the contracted upon it. There are conditions that must be present, so that if all or some of them are lost, the contract has no legal existence, and they are the terms of the session, because they are related to the formula. Then after that come the conditions of validity that, if fulfilled, the contract was valid to have its legitimate effects on it, and if it lagged, then the contract was corrupt then came after that the terms of enforcement and these, if fulfilled, lead to the effect of the contract already, then finally come the conditions of imperative, and the meaning of imperative: not to have one of the spouses. Or others have the right to cancel the contract.
