ملخص
تناول هذا البحث موضوع: (التصرف في الأجنة الفائضة من عمليات الحقن المجهري دراسة فقهية مقارنة), وقد تعرضت من خلال البحث لتعريف عمليات الحقن المجهري, والأجنة الفائضة عنها, والتصرفات الواردة عليها, مبينا الحکم الفقهي لعمليات الحقن المجهري المخلّفة للأجنة الفائضة بغرض الحصول على الولد, وبغرض تحديد جنس الجنين, ثم تعرضت لبيان تجميد الأجنة الفائضة, مبينا کيفيته وحکمه في الفقه الإسلامي, ثم تعرضت لبيان الحکم الفقهي لإعادة زرع الأجنة الفائضة في رحم الزوجة أثناء الحياة الزوجية, وبعد وفاة الزوج, وحکم زرعها في رحم غير الزوجة, ثم تعرضت لبيان حکم إتلاف الأجنة الفائضة في الفقه الإسلامي خارج الرحم, وداخله, ثم تعرضت لإجراء التجارب العلمية على الأجنة الفائضة, مبينا کيفيته, وحکمه في الفقه الإسلامي, ثم تعرضت لاستخدام الأجنة الفائضة في العلاج الطبي مبينا کيفيته, وحکمه في الفقه الإسلامي, ثم خاتمة بأهم النتائج والتوصيات.
Abstract
The study dealt with the subject of the disposal of surplus embryos from micro-injections comparative jurisprudence study. It was exposed through the research to identify the injections, the surplus embryos, and the behaviors contained therein, indicating the jurisprudential judgment of the abandoned micro-injections of the surplus embryos in order to obtain the child. And then subjected to the statement of the freezing of excess embryos, indicating the adequacy and wisdom in Islamic jurisprudence, after that subjected to the statement jurisprudence to re-implant the excess embryos in the womb of the wife during the marital life, after the death of the husband, and the rule of planting in the womb other than the wife, Embryos Surplus in Islamic jurisprudence outside the womb, and when inside it, then subjected to scientific experiments on surplus embryos, indicating how it is done, therefor his rule in Islamic jurisprudence, then subjected to the use of surplus embryos in medical treatment, indicating how it is done, the rule in Islamic jurisprudence, finally the conclusion
of the most important findings and recommendations.
