ملخص
يبين البحث أن فقهاء المذاهب الأربعة – على وجه العموم- لم يفردوا المقاصة بباب أو فصل مستقل، بل ذکروا تطبيقاتها موزعة على أبواب وفصول الفقه المتعددة. وقد تم في هذا البحث جمع عدد من التطبيقات الخاصة بالأحوال الشخصية الواردة في کتب المذاهب الأربعة من مهر، ونفقة، وتصرف الأولياء والأوصياء في أموال القاصرين، ودراستها، وبيان حکمها، ووجه المقاصة فيها . ويبين البحث أيضا أن المقاصة مطبقة في المحاکم الشرعية في المملکة الأردنية الهاشمية ، وقد تمت دراسة هذه التطبيقات على مستوى النصوص القانونية الناظمة لذلک، وعلى مستوى التنفيذ القضائي الشرعي .
Abstract
The research explained that the scholars of the four Madhabs –in general- didn,t distinguished the clearing in an independent chapters, however , they mentioned its applications in many chapters of the various fiqh discussions. In this research many of the applications of personal affairs were collected from the four Madhabs books, they are; the dowry, alimony, guardians and parents acts with youth money; then studying it to clarify the rule of the clearing in it. Further the study explains that the clearing is applied in Shari courts at the Hashimite Kingdom of Jordan. Those applications were studied on the level of the related legal texts as ell as the shari and judicial execution of those texts.
