البحث يتحدث عن موضوع التخريج؛ حيث لا تخفى أهميّته الكبيرة لكلّ فقيه مجتهد يبحث في حكم المسائل، وتناولت في البحث أنواع التخريج، ونشأته، وأهميته، ومراتبه، وشروطه، وقد خرج البحث في مبحث، وخمسة مطالب: الأول: تعريف التخريج، وأنواعه، والثاني: نشأة التخريج وموقف العلماء منه، والثالث: أهمية التخريج، والرابع: مراتب التخريج، ثم الخامس: شروط التّخريج، وقد خلص البحث إلى عدّة نتائج منها: أنّ علم التخريج مرتبط بعدّة علوم، وأن التخريج في اصطلاح الأصوليين والفقهاء، يطلق على عدّة معانِ، منها: تخريج المناط، والقياس، وتخريج الفروع على الأصول، والأصول من الفروع، والفروع من الفروع، وأنواعه الثلاثة: تخريج الفروع على الأصول، والأصول من الفروع، والفروع من الفروع، وأنه نشأ متأخرًا مع ظهور الحاجة إليه، وأهميته كبيرة لكلّ فقيه مجتهد تنمي ملكته الفقهية، وتجعله قادرًا على فهم النوازل والواقعات، وأن من مراتبه: التخريج المطلق والمقيد، ومن شروطه ما يتعلق بالمخرّج ذاته، كالإسلام، والعدالة، ومنها ما يتعلق بالتخريج، ومنه: أن يتحرّى قبل تخريجه ويجتهد في البحث عن نصّ، أو إجماع، أو قياس يمكن أن تقوم عليه المسألة.
This research discusses the topic of takhrij, highlighting its great importance for any diligent jurist investigating legal rulings. The study explores the types, origins, significance, ranks, and conditions of takhrij. It concludes that takhrij is interconnected with multiple Islamic disciplines and that the term has different meanings among legal theorists and jurists, such as takhrij al-manat, qiyas (analogy), deriving subsidiary rulings from foundational principles, deriving foundational principles from subsidiary rulings, and deriving subsidiary rulings from other subsidiary rulings. The study finds that takhrij emerged later due to necessity, is crucial for any diligent jurist, enhances jurisprudential ability, and aids in understanding contemporary issues. The ranks of takhrij include absolute and restricted takhrij, and its conditions include qualifications related to the person conducting takhrij (such as being Muslim and just) and those related to the process itself (such as diligent examination for textual, consensus-based, or analogical evidence before making a ruling).
