الناظر في تاريخ قضاة الإسلام، يجد أنهم طبقوا العدالة بكل معانيها، ومن ثم كان لكل منهم منهجًا قويمًا له سماته المنوطة به، وخصائصه التي تميزه عن غيره، ومن أهم القضاة الذين كان لهم أكبر الأثر في ذلك؛ القاضي شُريح بن الحارث الكندي (ت:78ه)، حيث إن منهجه لقي قبولًا واحترامًا في كل المذاهب الفقهية، وخاصة فيما يتعلق بمسائل القضاء فقوله فيها معتبر، وقضاؤه متبع محكم، فضلًا عن اتسامه بالجِدَّةِ فكرةً، والأصالة تطبيقًا منذ القِدم، وكان الهدف من هذه الدراسة التعريف بالقاضي شريح ومكانته العلمية، وتبيان منهجه في السياسة القضائية، ومدى التأثير والتأثر في ذلك، ولقد اجتهدت أن أسلك في هذا البحث المنهج التحليلي والاستقرائي وتطبيقهما عمليًا في جميع مواطن الدراسة ما أمكنني ذلك، وذلك باستقراء مادة هذا البحث من مصادرها المنوطة بها، وتحليلها وتركيب ما أتوصل إليه من تحليلات، والإفادة من كتب المعاصرين ومن أبرز النتائج ما يلي: تبيان منهج القاضي في السياسة القضائية، الذي كان له أثر كبير في الأحكام الشرعية والأحوال الشخصية وأحكام المعاملات المدنية، وكان لهذه المنهجية تأثير على القضاة الذين أتوا من بعده، وما قدمه من اجتهادات، فضلًا عن السمات العامة التي لابد من توفرها في القاضي كالذكاء والفطنة والحكمة.
One who examines the history of Islamic judges will find that they applied justice in all its meanings, and each of them had a sound approach with its own attributes and characteristics that distinguished it from others. Among the most important judges who had the greatest impact was Judge Shurayḩ bin Al-Ḩarith Al-Kindi (d. 78 AH), as his approach was accepted and respected in all schools of jurisprudence, especially with regard to judicial issues. The goal of this study is to introduce Judge Shurayḩ and his academic standing, and to explain his approach to judicial policy and the extent of his influence. I have endeavored to follow the analytical and inductive methods in this research and to apply them practically in all aspects of the study as much as I could. Among the most prominent results are the following: clarifying the judge's approach to judicial policy, which had a significant impact on legal rulings, domestic relations, and civil transaction rulings. His methodology – along with the rulings he reached through reasoning on new issues - had a great impact on the judges who came after him.
